Terms of Use (Bylaws)

Welcome to the Museum On The Seam website (hereinafter: "the Website"). Use of the Website and its services, including the purchase of tickets or making a donation, constitutes full, absolute, and irrevocable agreement to all terms of these Bylaws.

 

1. Definitions and Museum Details

2. Intellectual Property (Art, Content, and Prohibition of Use)

 

General: All content appearing on the Website, including texts, articles, graphics, website design, source code, and photographs of artworks (hereinafter: the "Protected Material"), is the exclusive property of the Museum and/or third parties who have permitted the Museum to use it (such as the Artists).

Artworks: Copyrights to the artworks displayed on the Website belong exclusively to the Artists, and the Museum has been granted permission to display the artworks in the Museum.

Explicit Prohibition: Users are strictly prohibited from:

  • Taking screenshots of the artworks or any other Protected Material.

  • Downloading, copying, or duplicating any materials from the Website.

  • Any commercial use of the Protected Material, including distribution, public presentation, or modification (processing) of the material, without explicit prior written authorization from the Museum and/or the Artist.

Journalistic Content: Excerpts and quotes from press articles appearing under "From the Press" are provided for general information purposes only. Copyrights to these excerpts belong to the original publishing entity.
 

 

3. Ticket Purchases and Donations

 

 

A. Ticket Purchases and Cancellation Policy

 

Transaction Execution: Ticket purchases are processed by redirecting to an external clearing (payment) website.

Cancellation and Refund Policy:

  • Initiated Cancellation: A ticket purchase may be canceled with a full refund, subject to notification to the Museum (in writing or by phone) up to 48 hours prior to the date of the visit/event specified on the ticket.

  • Late Cancellation: A cancellation made less than 48 hours before the scheduled time, or a no-show, will not entitle the user to a refund. This policy is subject to the provisions of the Israeli Consumer Protection Law.

 

B. Donations

 

Finality of Donation: A donation made through the Website is a voluntary contribution to promote the Museum's goals. A donation made on the Website is final and cannot be canceled or refunded (unless explicitly decided otherwise by the Museum management).

Tax Receipts: The Museum, being a registered Non-Profit Organization (NPO), will issue an appropriate receipt to the donor in accordance with Israeli law (Section 46 of the Income Tax Ordinance), provided the donation qualifies for a tax benefit.

 

C. Payment Clearing Liability

 

Transfer of Liability: The processing, security, and clearing of payment details are performed by external clearing providers and according to their stringent procedures (such as PCI DSS).

Exemption from Liability: The Museum is exempt from liability for any malfunction, damage, or loss of information resulting directly from the clearing operations or the information security measures of the external clearing provider.
 

 

4. Jurisdiction

 

Applicable Law: The use of this Website, these Bylaws, and any claim or dispute arising therefrom shall be governed exclusively by the laws of the State of Israel.

Exclusive Jurisdiction: The exclusive jurisdiction to hear any dispute regarding these Bylaws or the use of the Website is granted solely to the competent courts of the Jerusalem District.
